This Privacy Policy describes how ELEVYNX LLC ("ELEVYNX," "we," "us," or "our") collects, uses, discloses, and protects information when you visit elevynx.com (the "Website") or otherwise interact with us, including by submitting a contact or strategy session form, opting in to receive text messages, or communicating with us by email or phone.
By using the Website, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please do not use the Website.
1Who We Are
ELEVYNX LLC is a Texas limited liability company headquartered at 5900 Balcones Drive, Suite 100, Austin, TX 78731. For purposes of this Privacy Policy, ELEVYNX LLC is the entity responsible for determining how and why your personal information is processed in connection with the Website.
2Information We Collect
2.1 Information You Provide Directly
We collect information you voluntarily provide when you:
- Submit a Strategy Session request or other contact form, which may include your full name, company name, work email address, phone number, company revenue or growth stage, industry, primary growth challenge, and any additional information you choose to share in free-text fields.
- Opt in to receive SMS/text messages from us, which requires your mobile phone number and affirmative consent.
- Email us, call us, or otherwise communicate with us directly.
- Apply for a role with ELEVYNX or BRILZEN, if applicable, which may include resume and professional history information.
- Engage us as a client, in which case additional information will be governed by the terms of our signed services agreement with you and any client-portal-specific privacy terms provided at that time.
2.2 Information Collected Automatically
When you visit the Website, we and our service providers automatically collect certain information through cookies, web beacons, pixels, and similar tracking technologies, including:
Your IP address, browser type and version, device type and operating system, referring and exit pages, pages viewed, time spent on pages, click patterns, and approximate geographic location derived from your IP address.
2.3 Cookies and Tracking Technologies

- Analytics cookies (such as those used by website analytics tools), which help us understand how visitors use the Website so we can improve it.

3How We Use Your Information

- Advertise to and retarget visitors who have shown interest in ELEVYNX, in accordance with applicable advertising platform policies.

4SMS / Text Messaging Communications
If you provide your mobile phone number and affirmatively opt in through a form checkbox on our Website, you consent to receive SMS/text messages from ELEVYNX. We offer two separate categories of text messages, and you may consent to either, both, or neither:
- Account and service (transactional) messages — such as strategy session scheduling, appointment reminders, confirmations, and account or project updates.
- Marketing and promotional messages — such as new resources, insights, offers, and other promotional communications about ELEVYNX's services.
You will only receive the category or categories of messages for which you have provided consent. The following applies to all text messages from ELEVYNX:
- Message frequency varies depending on your interaction with us.
- Message and data rates may apply, as determined by your mobile carrier.
- You may opt out at any time by replying STOP to any message you receive from us. After you reply STOP, we will send a one-time confirmation message and will not send further messages unless you opt in again. You may reply HELP for assistance.
- Consent to receive text messages is not required as a condition of purchasing or receiving any service from ELEVYNX.
- Carriers are not liable for delayed or undelivered messages.
No mobile information, including your phone number and opt-in status, will be shared or sold to any third party or affiliate for their own marketing or promotional purposes. Mobile opt-in data is not shared with third parties except subcontractors and service providers acting solely on our behalf to deliver the messaging service you requested (for example, our SMS platform provider), and those parties are prohibited from using the information for any other purpose.

ELEVYNX is a US company. Some of the personnel and service providers who process information on our behalf may be located outside the United States. By using the Website or submitting your information to us, you acknowledge that your information may be processed by personnel and subprocessors located outside the United States, and that such processing will be subject to appropriate contractual and security safeguards.
7Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide services, maintain business records, comply with legal and tax obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the purpose for which it was collected.

9.2 California Residents
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), grants you the right to know what personal information we collect, use, disclose, and (where applicable) sell or share; the right to request deletion of your personal information; the right to correct inaccurate personal information; the right to opt out of the sale or sharing of personal information and the use of sensitive personal information for purposes beyond what is necessary to provide services; the right to limit the use of sensitive personal information; and the right to non-discrimination for exercising any of these rights. ELEVYNX does not sell personal information as defined under the CCPA. You may designate an authorized agent to make a request on your behalf, subject to verification.
9.3 Texas Residents
If you are a Texas resident, the Texas Data Privacy and Security Act ("TDPSA") grants you the right to confirm whether we are processing your personal data and to access that data; to correct inaccuracies; to request deletion; to obtain a portable copy of your data; and to opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. If you disagree with our response to your request, you may appeal by contacting us, and if the appeal is denied, you may contact the Texas Attorney General.
9.4 Other US State Residents
If you reside in a state with a comprehensive consumer privacy law (including but not limited to Colorado, Connecticut, Virginia, and Utah), you may have similar rights to access, correct, delete, and port your personal data, and to opt out of targeted advertising, the sale of personal data, and certain profiling. 9.5 European Economic Area, United Kingdom, and Switzerland
While ELEVYNX primarily serves US-based businesses, if you are located in the EEA, UK, or Switzerland and interact with the Website, we process your personal data on the basis of your consent, our legitimate interests in operating and promoting our business, or as necessary to respond to your inquiry. You have the right to access, correct, delete, restrict, or port your personal data, and to object to certain processing, by contacting us using the information in Section 14. You also have the right to lodge a complaint with your local data protection authority.
10Do Not Track
Some browsers offer a "Do Not Track" signal. Because there is not yet a uniform industry standard for recognizing this signal, the Website does not currently respond to Do Not Track signals.
11Children's Privacy
The Website is intended for business use by adults and is not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.
